Yes. If you got hurt tearing down or moving a structure in California, you can usually receive workers’ compensation when you are an employee. That includes medical care and a portion of your lost wages, even if the fall, the collapse, or the strain was an accident. Interior strip-out crews, machine operators, and the people who raise and move a house are covered when the company controls the work. You do not have to prove the contractor was careless. You do have to report the injury, get medical care, and file the claim on time. A 1099, a price per day, or the sentence “you bring your own bar” does not automatically end the claim.
People take the last wall because the truck is coming for the debris. Then the knee does not come back on the drive home. A floor that gives way, or a back that gave out after years of demo, can still be a work injury.

La versión corta de cómo funciona esto
California’s workers’ compensation system is no-fault. The insurance company is supposed to pay for a work injury without a courtroom fight over who pulled the wall. In exchange, you generally cannot sue the demolition company for pain and suffering the way you might after a car crash.
You can be hurt in one moment. A fall. A collapse. A machine. You can also be hurt slowly. California treats both as work injuries. A back, shoulder, or knee worn out by years of strip-out is still a work injury. So is a breathing problem the medicine ties to the dust. Those slower injuries are called cumulative trauma, or occupational disease, and they show up on demo sites.
Coverage generally starts day one for employees. It does not matter if you are paid by the day, by the house, or “just helping this teardown.”
¿Quién está cubierto en realidad?
Laborers and operators. If the company sends you to the address, sets the sequence, and can pull you off the job, you look like an employee. A W-2 makes it simple. The claim can still exist when pay is cash, a day rate, or a price per house.
The C-21 license. Building moving and demolition contractors are licensed in the C-21 classification. Title 16, section 832.21 of the California Code of Regulations covers raising, lowering, cribbing, underpinning, demolishing, and moving or removing structures, including their foundations. The classification does not include alterations, additions, repairs, or rehabilitation of the parts of the building that stay. Any employer with employees has to carry workers’ compensation. A C-21 license, by itself, is not proof that you are an independent contractor. If the company set the teardown and the schedule, bring those facts.
Asbestos and lead are their own facts. Removing asbestos-containing material is asbestos abatement, the C-22 classification, with a separate registration. Old paint in a house built before 1978 can contain lead. Breaking concrete throws silica dust. You do not have to sort the licenses to have a claim. You do have to tell the doctor what you were tearing out. If a wall came down and nobody surveyed it, write that down.
Equipos no autorizados trabajando con permisos. California generally requires a contractor’s license when the job is $1,000 or more in labor and materials. Assembly Bill 2622 set that small-job line at $1,000 starting January 1, 2025. The small-job exception is narrow once someone is hired to help. Labor Code section 2750.5 treats a worker doing licensed work without a valid license as an employee, and a valid license is a condition of independent-contractor status for that work. A cash crew on a teardown can still be a crew of employees.
Two names on one site. A general contractor, a demolition sub, and a labor outfit can all show up on one address. Write down every name on the invoice, the shirt, and the text that sent you the job. An uninsured employer does not erase the injury. Write down the names anyway.
House movers. C-21 also covers raising and moving a structure. A worker hurt cribbing, jacking, or hauling a house is in the same employment question. Say what you were actually doing.
Trabajadores indocumentados.

What kinds of demolition injuries actually qualify?
Almost any injury that arises out of the job and happens in the course of the job. On a teardown, that means:
- Falls from floors, roofs, ladders, and openings
- Being struck by a wall, a beam, debris, or a machine
- Back, shoulder, and knee injuries from prying, loading, and years of strip-out
- Cuts and punctures from nails, rebar, and metal
- Breathing problems tied to silica, old paint dust, or other material, when the medicine supports it
- Eye injuries from chips and dust
- Heat illness on an open slab in the afternoon
- A crash while you are riding in the company truck between sites
Tell the doctor what you were taking apart and what the dust was. Concrete, drywall, roofing, and old insulation are different facts. If you know the house was old, say so. A breathing problem that builds over months can be an occupational disease. Labor Code section 5412 often sets that date of injury as the date you first had disability and knew, or should have known, the work caused it. The longer note on chemical exposure is in our Articulo sobre la exposición a productos químicos.
Psychiatric claims have extra rules. A floor collapse does not.
A lot of people wait because the first weeks were “just sore.” Then the back will not take another day of loading. If a foreman told you to finish the wall after you reported pain, write down the date, the name, and what they said.
Heat on a summer teardown is still a work injury. The longer note is in our Articulo sobre la enfermedad por calor. Si la lesión se debe principalmente a una caída, nuestro Articulo sobre accidentes de caída goes further on that pattern. This page is about the demolition job.
The drive from your house to the site in your own car is usually a commute. Riding in the company truck between teardowns is a different fact. Write down whose truck it was and who assigned the stops.
The teardown wrinkle: the day rate, the dust, and the machine
El horario no es una defensa legal. Getting hurt because the debris box had to be full does not kill the claim. You do not have to prove the sequence was illegal. If someone later says you pulled the wall wrong, write down the structure, the tool, and how many people were actually on it.
Some demo crews never see a normal hourly stub. The number you actually took home can belong in your average weekly earnings. Bring the texts and what you deposited.
A collapse does not make the injury your private problem. Structures fail. A fall or a strike while you are taking one apart is still a work injury. Write down what gave way.
The machine is a tool of the job. An operator hurt on an excavator or a skid steer, and a laborer struck by one, can both have claims. Write down the machine and who was running it. If a piece of equipment failed, write down the make. A product case, when the facts support one, is separate from the workers’ compensation claim.
Doctor visits, imaging, physical therapy, surgery, prescriptions, and mileage to appointments. Authorized care for the work injury should not come out of your pocket. A breathing problem needs the testing the medicine calls for, not a promise that the dust was “just dust.”
Incapacidad temporal (IT).
Discapacidad permanente (DP). If the injury leaves lasting limits, you may receive a permanent disability award based on a medical rating. Demolition is not a desk job. The rating should reflect the lifting, the debris, and a real site.
Notice what is not on that list: a big pain-and-suffering check from the demolition company itself. That is the trade-off of the no-fault system. Another driver, or the maker of a failed machine, is a different question.
Qué hacer en las primeras 48 horas
- Get medical care. ER for a fall, a blow to the head, trouble breathing, a crush, or a bone you can see is wrong. Urgent care or a real exam if it is not an ambulance. Tell them it happened at work, and name the dust if you can.
- Write down who saw it, what you were tearing out, and every company name on the job.
- Photograph the opening or the debris from a safe place. Do not go back into a failing structure for the picture.

How Laguna Law Firm helps injured demolition workers
We are a California workers’ compensation firm. We help people on teardowns, in machines, and on crews get medical care authorized and benefits paid.
What that looks like: we review what you told the foreman, we sort the general contractor versus the demolition sub, we build the wage rate from the day rate they left out, we file what still needs filing, and we fight treatment delays and stingy ratings. We look for a case against another driver, or against a product maker, only when the facts support one.

Preguntas frecuentes
I am paid cash by the day and I get a 1099. Am I covered?
Maybe. A 1099 does not decide it. If the company sent you to the address and set the teardown, bring those facts.
The cough showed up after months of concrete dust, not one wall.
That can be an occupational disease. Tell the doctor you were breaking concrete or taking down old paint. Report it, and use the date you first knew the work was causing it.
Nobody tested the building for asbestos.
Write down the age of the building and what you tore out. The claim can still exist. The material belongs in the chart.
The floor gave way. The company says I should have seen it.
The claim is no-fault. Write down the structure, who set the sequence, and who saw it.
¿Puedo elegir a mi propio médico?
We move houses. We do not wreck them.
Raising and moving a structure is part of the same C-21 classification. Say what you were doing. The employment question is the same.
En pocas palabras
A demolition worker hurt on the job in California can receive workers’ compensation. The day can be a strip-out, a machine, or a house on cribbing. The injury can be one collapse or a breathing problem that built over a year of dust. The claim can still be real.
The hard part is the cash pay, the day rate that never made a normal stub, and the fear that the next site will go to someone else. That is the part we handle.
