Yes. If you got hurt driving a school bus in California, you can usually receive workers’ compensation when you are an employee. That includes medical care and a portion of your lost wages, even if the crash, the fall, or the strain was an accident. District drivers, contractor drivers, and a lot of people who also run activity trips are covered when the employer controls the work. You do not have to prove the district or the company was careless. You do have to report the injury, get medical care, and file the claim on time. A special certificate, a split shift, or the sentence “you are a substitute” does not automatically end the claim.

People finish the route because the last stop still has kids on the sidewalk. Then the knee does not come back in the yard. A crash on the afternoon route, or a back that gave out after years of the same streets, can still be a work injury.

La versión corta de cómo funciona esto

California’s workers’ compensation system is no-fault. The insurance company is supposed to pay for a work injury without a courtroom fight over who had the right of way. In exchange, you generally cannot sue your employer for pain and suffering the way you might sue another driver after a crash.

You can be hurt in one moment. A crash. A fall on the step. A student who strikes you. You can also be hurt slowly. California treats both as work injuries. A back, neck, or shoulder worn out by years of routes, mirrors, and wheelchairs can still be a work injury. Those slower injuries are called cumulative trauma, and they show up on bus routes.

Coverage generally starts day one for employees. It does not matter if you are a substitute, a midday driver, or “just covering this week.”

¿Quién está cubierto en realidad?

School district drivers. If the district assigns the route, owns the bus, and signs the paycheck, you are an employee of the district. Districts often handle claims through a claims administrator or a joint powers authority. The letterhead may not match the name on the bus. The claim is still a California workers’ compensation claim. Write down the district and the name on the letter.

Private bus contractors. Many routes are driven by employees of a company the district hired. If that company sets your yard, your route, and your clock-in, you look like that company’s employee. File against that company’s policy unless the facts show the district was also an employer. Write down both names when the bus says one thing and the stub says another.

Activity-trip and pupil-activity drivers. A school pupil activity bus is a different certificate and a different kind of trip. Field trips and sports runs are still work when the employer sent you. The certificate category belongs in the file. It does not erase the injury.

The special certificate. California school bus drivers need a commercial license with the right endorsements and a Special Driver Certificate issued through the California Highway Patrol. Vehicle Code section 12517 is the certificate statute people mean. The certificate shows you met a licensing rule. It does not, by itself, make you an independent contractor. Substitutes and trainees on the employer’s payroll can still be employees.

Two yards, one employer. Some drivers bounce between a district yard and a contractor yard, or between two routes with different company names. Bring both. The wage math can include both when the law treats the earnings as part of the same picture.

Trabajadores indocumentados.

If you are not sure which bucket you fall into, bring the route bid and a pay record.

What kinds of school bus injuries actually qualify?

  • Injuries in a crash while you are driving the route or a trip
  • Back, neck, and shoulder injuries from the wheel, the mirrors, and years of the same stops
  • Falls on the step, in the aisle, or in the yard
  • Injuries while securing wheelchairs or helping a student
  • Being struck or injured in a fight or an assault on the bus
  • Slips in the yard, on the fuel island, or on a wet step
  • Heat illness on a bus with failed air, when you are stuck on the route

The drive from your house to the yard in your own car is usually a commute. Driving the bus on the route, a trip, or between schools is a different fact. Write down whose bus it was and who assigned the work.

A physical injury from an assault is a work injury. Psychiatric claims have extra rules, and a violent act can change those rules. Write down what happened. Do not assume a stress claim is closed, and do not assume it is simple.

A lot of people wait because the first weeks were “just sore.” Then the leg goes numb on the afternoon route. If a dispatcher told you to finish the route after you reported pain, write down the date, the name, and what they said.

The route wrinkle: the certificate, the contractor, and the other driver

The bell schedule is not a legal defense. Getting hurt because the route had to make the bell does not kill the claim. You do not have to prove the schedule was illegal. If someone later says you were rushing, write down the route number and how many stops were on it.

Un accidente puede ser de dos tipos. Workers’ compensation is the claim against your employer’s program. If another driver caused the crash, that driver and their insurer can be a civil case on top of the claim. Those cases have different deadlines and can include pain and suffering. You can have both. Do not give a recorded statement to the other driver’s insurer, and do not sign a yard paper that gives one of the cases away.

Split shifts and extra trips belong in the wage math when they were real. Morning routes, midday routes, and activity trips can all be earnings. A stub that shows only the contracted route hours is often incomplete. Bring the trip sheets.

A fall in the yard is still the job. Pre-trip, fueling, and sweeping the bus are work. You do not have to be rolling with students on board.

You should not have to run a work injury through a personal plan because the yard does not want a claim. You should not have to burn sick days in place of temporary disability if you qualify for TD.

Incapacidad temporal (IT). If you cannot work, or you can only work reduced hours, you may get wage replacement. In California that is generally two-thirds of your average weekly earnings, subject to state minimums and maximums. For injuries on or after January 1, 2026, the Division of Workers’ Compensation set the minimum weekly temporary total disability rate at $264.61 and the maximum at $1,764.11. The rate follows the date of injury. Extra trips and a long route, if they were real earnings, belong in that number. There is usually a short waiting period, often three days, unless you are hospitalized or off long enough for it to be waived. Many claims also face a time cap, often 104 weeks within a five-year window, with exceptions for some severe injuries.

Discapacidad permanente (DP). If the injury leaves lasting limits, you may receive a permanent disability award based on a medical rating. Driving a route is not a desk job. The rating should reflect the wheel, the steps, and a real day of stops.

Beneficio suplementario por desplazamiento laboral. If you cannot go back to your old job and the employer does not offer qualifying alternative work, you may get a voucher for retraining. In many cases that voucher is up to $6,000. Public employment can change how return-to-work offers work. Bring the offer in writing before you turn it down.

Notice what is not on that list: a big pain-and-suffering check from the district or the bus company itself. That is the trade-off of the no-fault system. The other driver is a different question.

Qué hacer en las primeras 48 horas

  1. Get medical care. ER if you were in a crash, you hit your head, or you cannot walk. Urgent care or a real exam if it is not an ambulance. Tell them it happened at work.
  2. Tell the dispatcher or the supervisor, the same day if you can.
  3. Follow up in writing. Text or email with the date, the body part, and the route or trip number.
  4. Solicite el formulario de reclamo DWC-1. Llene la sección del empleado. Conserve una copia.
  5. Write down who saw it, whose bus it was, and the other driver’s information if there was a crash.
  6. Photograph the step or the damage if it is safe and the bus is parked. Do not walk into traffic for the picture.

How Laguna Law Firm helps injured school bus drivers

We are a California workers’ compensation firm. We help people on routes, in yards, in shops, and on crews get medical care authorized and benefits paid.

What that looks like: we review what you told the dispatcher, we sort the district versus the bus contractor, we build the wage rate from the extra trips they left out, we file what still needs filing, and we fight treatment delays and stingy ratings. We look for a case against another driver only when the facts support one.

Preguntas frecuentes

I only drive when someone calls out. Am I covered?
If you are an employee, substitute work can still count. The benefit math uses your earnings.

The pain showed up after years of routes, not one crash.

The letter came from a joint powers authority I have never heard of.
Public employers often use an outside administrator. Write down the district and the name on the letter. The claim can still be real.

¿Puedo elegir a mi propio médico?

Another driver hit the bus. Is that only an auto claim?

I hold a special certificate. Does that make me a contractor?
No. The certificate is a license to drive the bus. Bring who assigned the route and who paid you.

En pocas palabras

A school bus driver hurt on the job in California can receive workers’ compensation. The day can be a home-to-school route, a sports trip, or a pre-trip in the yard. The injury can be one crash or a back that gave out after years of the same streets. The claim can still be real.

The hard part is the district-versus-contractor paperwork, the extra trips that never made the wage statement, and the fear that the next bid will leave you off the list. That is the part we handle.
