Yes. If you got hurt collecting trash or working a recycling line in California, you can usually receive workers’ compensation when you are an employee. That includes medical care and a portion of your lost wages, even if the slip, the needle, or the strain was an accident. Drivers, helpers, and sorters are covered when the city or the company controls the work. You do not have to prove the employer was careless. You do have to report the injury, get medical care, and file the claim on time. A temp badge, a route bonus, or the sentence “you knew the work was dirty” does not automatically end the claim.

People finish the alley because the route still has stops. Then the back does not come back at the yard. A fall off the step, or a shoulder that gave out after years of cans, can still be a work injury.

La versión corta de cómo funciona esto

California’s workers’ compensation system is no-fault. The insurance company is supposed to pay for a work injury without a courtroom fight over who set the can out wrong. In exchange, you generally cannot sue the city or the hauling company for pain and suffering the way you might sue another driver after a crash.

You can be hurt in one moment. A fall from the step. A needle. A car that hits you in the alley. You can also be hurt slowly. California treats both as work injuries. A shoulder, back, or knee worn out by years of cans, hoppers, and the sort line is still a work injury. Those slower injuries are called cumulative trauma, and they are common on routes and in recycling plants.

Coverage generally starts day one for employees. It does not matter if you are on a spare board, a Saturday route, or “just helping the line this week.”

¿Quién está cubierto en realidad?

City crews. If a city sanitation department assigns the route, owns the truck, and signs the paycheck, you are an employee of the city. Cities often handle claims through a claims administrator or a joint powers authority. The letterhead may not match the name on the truck. The claim is still a California workers’ compensation claim. Write down the city and the name on the letter.

Private haulers. Many California cities franchise collection to a private company. If that company sets your yard, your route, and your clock-in, you look like that company’s employee. File against that company’s policy unless the facts show the city was also an employer. Write down the name on the truck and the name on the stub. They are often different.

Helpers and drivers. People who drive, people who ride the step, and people who pull cans on a route that is not fully automated all get hurt. An automated truck does not end the claim. Hoppers, backing, and getting in and out of the cab still injure people.

Recycling plants and transfer stations. Sorters, equipment operators, and yard workers at a materials recovery facility get hurt too. The building is a workplace. A temp agency and the plant can both be in the employment picture. Write down both names.

Building custodians are a different job. Night crews who clean offices and schools have their own article, our janitor and custodian guide. This page is about collection, the route, and the plant.

Trabajadores indocumentados.

If you are not sure which bucket you fall into, bring the route sheet and a pay record.

What kinds of collection injuries actually qualify?

Almost any injury that arises out of the job and happens in the course of the job. On a route or a line, that means:

  • Back, shoulder, and knee injuries from cans, carts, hoppers, and years of the same stops
  • Falls from the truck step, the hopper, or a wet alley
  • Being struck by a car, a bike, or the truck itself while you are collecting
  • Needlesticks and cuts from trash
  • Repetitive injuries on a sort line
  • Being caught or struck by machinery at a plant
  • Heat illness on a walking route or a yard in the afternoon
  • A crash while you are driving or riding in the truck

Tell the doctor the route or the plant, and what you were lifting. A needle in a bag and a fall from the step are different facts. A needlestick needs care the same day. Name it.

Psychiatric claims have extra rules. A fall from the step does not. A violent event in the alley can change the psychiatric rules. Write down what happened.

A lot of people wait because the first months were “just sore.” Then the shoulder will not take the carts. If a supervisor told you to finish the route after you reported pain, write down the date, the name, and what they said.

This page is about collection and recycling work.

The drive from your house to the yard in your own car is usually a commute. Driving the truck on the route, or riding it between stops, is a different fact. Write down whose truck it was and who assigned the route.

The route wrinkle: the city, the franchise, and the other driver

The route clock is not a legal defense. Getting hurt because the stops had to be done does not kill the claim. You do not have to prove the staffing was illegal. If someone later says you lifted wrong, write down the route, the carts, and whether you were alone.

A crash or a strike can be two cases. Workers’ compensation is the claim against your employer’s program. If another driver hit you or hit the truck, that driver and their insurer can be a civil case on top of the claim. Those cases have different deadlines and can include pain and suffering. You can have both. The workers’ compensation claim does not disappear because you were in the street. Do not give a recorded statement to the other driver’s insurer, and do not sign a yard paper that gives one of the cases away.

Route pay, overtime, and a spare-board shift belong in the wage math when they were real. A stub that shows only the base day is often incomplete. Bring the route sheets.

A needle is a work injury. Write down the stop, the bag, and when you told the supervisor. Follow the medical instructions. Do not let anyone call it a personal problem because the trash was a resident’s trash.

You should not have to run a work injury through a personal plan because the yard does not want a claim. You should not have to burn sick time in place of temporary disability if you qualify for TD.

Doctor visits, imaging, physical therapy, surgery, prescriptions, and mileage to appointments. Authorized care for the work injury should not come out of your pocket. A needlestick needs the follow-up the medicine calls for.

Incapacidad temporal (IT). If you cannot work, or you can only work reduced hours, you may get wage replacement. In California that is generally two-thirds of your average weekly earnings, subject to state minimums and maximums. For injuries on or after January 1, 2026, the Division of Workers’ Compensation set the minimum weekly temporary total disability rate at $264.61 and the maximum at $1,764.11. The rate follows the date of injury. Overtime and route pay, if they were real earnings, belong in that number. There is usually a short waiting period, often three days, unless you are hospitalized or off long enough for it to be waived. Many claims also face a time cap, often 104 weeks within a five-year window, with exceptions for some severe injuries.

Discapacidad permanente (DP). If the injury leaves lasting limits, you may receive a permanent disability award based on a medical rating. Collection work is not a desk job. The rating should reflect the cans, the step, and a real route.

Beneficio suplementario por desplazamiento laboral. If you cannot go back to your old job and the employer does not offer qualifying alternative work, you may get a voucher for retraining. In many cases that voucher is up to $6,000. It is not automatic. Public employment can change how return-to-work offers work. Bring the offer in writing before you turn it down.

Notice what is not on that list: a big pain-and-suffering check from the city or the hauling company itself. That is the trade-off of the no-fault system. The other driver is a different question.

Qué hacer en las primeras 48 horas

  1. Get medical care. ER if you were struck, you fell from the truck, you hit your head, or you cannot walk. A needlestick needs prompt care too. Tell them it happened at work.
  2. Tell the supervisor, the same day if you can.
  3. Follow up in writing. Text or email with the date, the body part, and the route or the plant.
  4. Solicite el formulario de reclamo DWC-1. Llene la sección del empleado. Conserve una copia.
  5. Write down who saw it, the stop, and the other driver’s information if a vehicle was involved.
  6. Photograph the step or the scene if it is safe and you are out of traffic. Do not stand in the alley for the picture.

How Laguna Law Firm helps injured collection workers

We are a California workers’ compensation firm. We help people on routes, in yards, and on sort lines get medical care authorized and benefits paid.

What that looks like: we review what you told the supervisor, we sort the city versus the private hauler versus the temp agency, we build the wage rate from the overtime they left out, we file what still needs filing, and we fight treatment delays and stingy ratings. We look for a case against another driver only when the facts support one.

Preguntas frecuentes

I work for a private company, but the truck says the city. Who is the employer?
Bring both names. Franchise haulers are often the employer. The city can still matter. Write down the stub and the door of the truck.

The pain showed up after years of carts, not one fall.

I only sort at the plant. I do not ride a truck.
Plant work counts. Say whether a temp agency sent you. Write down both names.

A driver hit me while I was pulling a cart. Is that only an auto claim?

Public employers often use an outside administrator. Write down the city and the name on the letter. The claim can still be real.

¿Puedo elegir a mi propio médico?

A garbage or recycling worker hurt on the job in California can receive workers’ compensation. The day can be a route, a hopper, or a sort line. The injury can be one fall or a shoulder that gave out after years of cans. The claim can still be real.

The hard part is the city-versus-hauler paperwork, the overtime that never made the wage statement, and the fear that the next bid will leave you off the route. That is the part we handle.
